Terms and Conditions

INTRODUCTION

This document establishes the terms and conditions for using the platform and the rights of the platform user. By placing an order, the user agrees to enter into a contract with the company.

DEFINITIONS

Company: A limited liability company "Tamira," registered under Georgian law with identification number: 416347466, address: Tbilisi, Vanis St. #3.

User: Any natural or legal person who uses the platform, including but not limited to platform visitors, registered users, and former users.

Platform: The e-commerce platform www.tamira.com.ge, solely and legally owned by the company.

Products: Any items offered to the user via the platform.

USER ACCOUNT

To fully utilize the platform, users must create an account. To do so, the user must follow the instructions provided on the platform, enter all necessary information, and agree to these terms and conditions. Additional verification may be required if needed.

The user is responsible for the accuracy of the information provided during account creation.

The company reserves the right to request further confirmation of the accuracy of the information provided. The user must comply with the company’s request and provide all necessary information within a reasonable timeframe.

Users are responsible for securely storing their account details and ensuring they are inaccessible to third parties. If a user suspects that their account details have been accessed by a third party, they must immediately change them.

The platform is intended only for adult users. If the user is a minor, they must create an account only with the consent of a parent or legal guardian.

Creating multiple accounts by one person is prohibited. Users are permitted to manage only one account. The company reserves the right to delete or block alternative accounts.

Users are responsible for any actions taken through their account. If someone acts on behalf of the user or with their instructions, it is assumed they have the authority to do so. The company is not liable for damages resulting from unauthorized access to the account.

Users may request account cancellation by contacting the company. The company will cancel the account within 10 (ten) business days, unless the user has an outstanding debt. In such cases, the account will only be canceled once the debt is fully paid.

The company reserves the right to cancel a user’s account if there is reasonable suspicion that the user is violating these terms and conditions, legal requirements, or if there is another legitimate reason.

USER DECLARATIONS AND WARRANTIES

By agreeing to these terms and conditions, the user declares and warrants that:

They are legally capable of entering into this agreement and that their use of the platform does not violate applicable laws, including not being subject to current or future economic or trade sanctions.

The information provided is accurate, not false, misleading, or incorrect.

They will not engage in any actions that are prohibited or violate the platform's terms and conditions, privacy policy, or other regulatory documents. They will also not engage in any illegal, discriminatory, or fraudulent activities that harm or may harm the rights of third parties.

ORDERS

To place an order, the user must follow the platform’s instructions.

After placing an order, the user will be notified via the platform that the order has been placed.

Before receiving the order, the user has the right to modify or cancel it by contacting the company. However, the user cannot cancel an order if there is less than 1 (one) business day remaining before delivery.

The company reserves the right to cancel an order immediately if there is an objective reason, such as the unavailability of stock, a technical error on the platform, a violation of these terms and conditions by the user, fraudulent activity, or other legitimate reasons.

The user will be notified of the order cancellation immediately but no later than within 2 (two) business days, unless restricted by regulatory law.

PAYMENT METHODS

Users may choose to pay via cashless or cash transactions by following the platform's instructions.

Payments are processed in a secure area managed by a financial institution, which the company does not have access to.

In the event of order cancellation, the company undertakes to refund the amount paid by the user immediately, but no later than within 14 (fourteen) calendar days.

ORDER DELIVERY

According to customers choice the company delivers the ordered products either directly or through a contracted courier service. If agreed between the company and the user, the user may arrange transportation of the products from the company’s warehouse themselves.

If the company or the contracted courier service handles the delivery, the company is responsible for the safe transportation of the products. However, if the user transports the products from the company’s warehouse, the company’s responsibility for product transportation is fully excluded.

Delivery times depend on the product. If the ordered product is in Georgia, it will be delivered to the user within 2-5 business days. In rare cases, delivery may take longer, but no more than 20 (twenty) calendar days.

If the product is not in Georgia, the delivery time varies, and the company will inform the user about it after the order is placed. If the user finds the delivery time unacceptable, they should cancel the order. The conditions for individual orders are additionally agreed upon between the user and the company.

The product description includes information about the product’s location. When placing an order, the user is informed whether the product is in Georgia or if the company needs to order it and import it into Georgia for delivery to the user.

Delivery is made to the building entrance. The delivery does not include carrying the product inside or moving services.

The order should be received by the user. If the user wants a third party to receive the order, they must immediately inform the company and provide the third party’s details: name, phone number, and address.

Upon delivery, the user or the authorized person must inspect the product and ensure it fully matches the order and has no visible defects. If the product has any defects, the user or the authorized person should not accept it and should immediately contact the company. Upon receiving the product, the user or the authorized person must sign the product acceptance document.

RIGHT TO UNCONDITIONAL PRODUCT RETURN

Only users who are natural persons can exercise the right to unconditional product return. This right does not apply to users who are legal entities.

The user has the right to return the product to the company within 14 (fourteen) calendar days of receiving it, without providing any reason.

If the user wishes to return the product, they must fill out the return form.

The user is responsible for arranging the transportation of the product and returning it to the company or a third party designated by the company within 7 (seven) calendar days after submitting the return request to the following address: Tbilisi, Vanis St. #3.

The user must return the product in full, including all accompanying documents.

The company must refund the amount paid by the user within 14 (fourteen) calendar days of receiving the return notification. The company reserves the right to withhold the refund until it receives the product or a shipping confirmation from the user, whichever occurs first.

Refunds will be made using the same payment method used by the user unless the user agrees to a different payment method.

The user’s withdrawal from the product purchase and its return automatically terminates the related contract and restores the original conditions.

The user does not have the right to return the product in the following cases:

  • The price of the delivered product depends on changes in the financial market, which the company cannot control and which occur within the period specified in this document.
  • The product was made or customized according to the user’s individual order.
  • The delivered product is perishable or has a short expiration date.
  • The product was delivered in a sealed package, and the seal was broken after delivery, making it impossible to return the product for health or hygiene reasons.
  • The delivered product was inseparably mixed with other products due to its nature.
  • The seal on delivered audio or video recordings or software was broken after delivery.
  • Newspapers, magazines, or other periodic publications.
  • The product was purchased at a public auction.
  • Digital content was provided without a physical medium, and the execution of the contract began with the user’s prior consent.
  • Products valued at 30 GEL or less.

The company is entitled to proportionally reduce the refund amount if the product has been used and is not in its original condition when returned.

LIMITATION OF THE COMPANY’S LIABILITY

The company does not guarantee that the platform will be continuously available or always operate without interruptions. However, it is liable for damages caused by platform malfunctions that violate user rights under the Georgian Law on "Consumer Rights" and the Georgian Law on "Electronic Commerce."

PROTECTION OF INTELLECTUAL PROPERTY

The user must not take any action that infringes on the intellectual property rights of the platform or any third party. Unauthorized use, modification, or publication (including on social media) of any information or content on the platform, including logos, graphics, images, trademarks, designs, visual media created by the company, platform design, software, core program codes, and other intellectual property (registered or unregistered), is prohibited without the company’s prior written consent. Reproduction, distribution, or redistribution of the platform’s content, in whole or in part, through any means (including caching, creation), selling, reselling, retransmission, or sharing with third parties is not allowed. If any material on the platform can be downloaded or printed, it may only be downloaded on one device and solely for the user’s personal, non-commercial use.

DISPUTE RESOLUTION/LEGISLATION

The relationship between the user and the company is governed by Georgian law.

If the user has a complaint, they are entitled to contact the company in writing using the contact information provided in these terms and conditions. The company will review the complaint and respond within 14 (fourteen) calendar days.

Any dispute will be resolved through negotiation. If negotiations fail, the user may contact the Georgian Competition and Consumer Protection Agency (depending on the nature of the dispute) or directly approach the court.

CHANGES/ADDITIONS

This document may be unilaterally amended by the company at any time. Registered users will be notified within a reasonable period in advance via a mandatory notification in their personal account, email, or SMS.
